Roca River Camp Registration & Waiver
By signing below, I hereby confirm that I have carefully read this Waiver of Liability and Indemnity (at the bottom of the page) and fully understand all of its contents, and their legal effect. I agree that this Waiver of Liability and Indemnity is contractually binding, and that I am signing it on my own free will. I also hereby agree, on behalf of my child or ward, to all of the terms of such Waiver of Liability and Indemnity, and hereby give my permission to my child or ward to visit the Maasai Mara National Reserve. I also acknowledge the details given above as true to the best of my knowledge.
Roca River Camp is operated by Mobile Expeditions Ltd within the Maasai Mara National Reserve, a remote wilderness environment where safari travel and related activities involve inherent risks which cannot be entirely eliminated, despite all reasonable precautions being taken for guest safety. For the purposes of this indemnity, “Roca River Camp” shall include Mobile Expeditions Ltd trading as Roca River Camp together with its owners, directors, managers, employees, guides, agents, contractors and associated service providers.
I acknowledge that visiting Roca River Camp and the Maasai Mara National Reserve involves travel within a remote wildlife area where there are inherent risks associated with safari activities, wildlife encounters, unpredictable weather, rough terrain and limited access to emergency services. I undertake this visit entirely at my own volition and risk.
I acknowledge that safari travel and related activities involve inherent risks and circumstances beyond the reasonable control of Roca River Camp, and I accept responsibility for exercising reasonable care for my own safety and for those travelling with me. To the fullest extent permitted by applicable law, Roca River Camp shall not be liable for loss, damage, injury, illness, delay or inconvenience arising from participation in safari activities or travel within remote wildlife areas.
Guests are expected to follow all reasonable safety instructions provided by camp management, guides and staff at all times in the interests of guest safety.
Guests confirm that they are medically fit to undertake safari travel and related activities and shall inform camp management prior to arrival of any medical condition, allergy, disability, pregnancy or dietary requirement which may reasonably require assistance or special arrangements. Roca River Camp cannot guarantee access to specialised medical facilities in remote areas.
Guests are required to obtain comprehensive travel, medical and evacuation insurance prior to travel. Roca River Camp shall not be liable for costs, losses or expenses which would ordinarily be covered by such insurance.
In the event of illness, injury or emergency, Roca River Camp may arrange medical treatment or evacuation on behalf of the guest where reasonably necessary. Any costs associated with such treatment, evacuation or transport shall remain the responsibility of the guest or their insurers.
Safari travel may be affected by weather, flooding, wildlife movement, government restrictions, political unrest or other unforeseen events beyond the reasonable control of Roca River Camp. No refund or compensation shall be payable for delays, interruptions, itinerary changes or additional costs arising from such circumstances.
Certain services, including air transfers, road transfers, balloon safaris or other third-party activities, may be operated by independent providers. Guests participating in such activities do so subject to the terms, conditions and safety procedures of the relevant operator, and Roca River Camp shall not be liable for incidents arising from services provided by such independent operators.
Roca River Camp reserves the right to refuse participation in activities or to require a guest to leave the camp where, in the reasonable opinion of management, the guest’s behaviour places themselves, other guests, staff, wildlife or property at risk, or materially disrupts the experience of others.
For the purposes of this indemnity, a minor shall mean any person under the age of 18 years. Where this form is signed on behalf of a minor, the parent or legal guardian confirms acceptance of these terms on behalf of the child and accepts responsibility for the child’s supervision and safety during the stay.
Guests are encouraged to take reasonable care of personal belongings and to use any safekeeping facilities provided for valuables, passports, cash and travel documents. Any liability for loss of or damage to guest property shall be subject to applicable Kenyan law, including the Hotels and Restaurants Act (Cap. 494, Laws of Kenya).
The guest signing this indemnity confirms that they do so on their own behalf and, where applicable, on behalf of members of their travelling party, including minors under their care.
This acknowledgement and assumption of risk shall be binding upon the guest, their heirs, executors, administrators and assigns.
Should any provision of this indemnity be found unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
This indemnity and any related agreements shall be governed in accordance with the laws of Kenya.
